Terms of Service (Beta)

Important Beta Notice

The Services are in beta. Features may change, support is best-effort, and results may be incomplete. Do not use the beta for safety-critical or legally required processes.

1. Acceptance of Terms

These Terms govern your access to and use of FoundryOps services, including the website, APIs, the g-gremlin CLI, and any FoundryOps Sheets apps or add-ons (collectively, the "Services").

By creating an account, clicking "I agree," or using the Services, you agree to these Terms and our Privacy Policy.

These Terms are an agreement between you (or your organization) and ScaledRev, LLC (doing business as FoundryOps) ("ScaledRev," "FoundryOps," "we," or "us").

2. Eligibility and Accounts

  • You must be at least 18 years old.
  • You must have authority to bind your organization (if applicable).
  • You are responsible for account security and API keys.

3. Beta Program Terms

  • Beta features may be incomplete, change, or be discontinued at any time.
  • Support is best-effort and not guaranteed.
  • Outputs may be incorrect or incomplete; validate before relying on results.

4. License to Use the Software

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the g-gremlin CLI and related tools solely for your internal business purposes.

  • You may not sell, resell, rent, lease, or sublicense the Services.
  • You may not reverse engineer or attempt to derive source code (except where prohibited by law).
  • You may not bypass security or access controls.
  • You may not use the Services to build a competing product.

5. API Keys and Security

  • API keys are confidential and tied to your account.
  • Do not share or expose keys publicly.
  • Rotate keys if you suspect compromise.

We may suspend or revoke keys if we believe they are compromised or misused.

6. Acceptable Use

  • Do not violate laws or regulations.
  • Do not infringe intellectual property or privacy rights.
  • Do not transmit malware or attempt unauthorized access.
  • Do not disrupt infrastructure or abuse rate limits.

7. Customer Data and Responsibilities

"Customer Data" means the data you submit or connect via integrations. You are responsible for ensuring you have the rights to process and share Customer Data.

Some workflows run locally on your machine. We may store metadata, logs, and receipts needed to operate the Services, but we do not ingest CRM data unless you explicitly push it to a connected sink.

8. Feedback

If you provide feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free right to use it without compensation or obligation.

9. Intellectual Property

We and our licensors retain all rights in the Services, software, and documentation. Except for the limited license above, no rights are granted to you.

10. Third-Party Services

The Services may integrate with third-party products. Your use of those services is governed by their terms, and we are not responsible for third-party outages or changes.

11. Fees and Trials

If any portion of the Services is paid, you agree to pay fees as presented at checkout or in an order form. During beta, fees may be waived or discounted at our discretion.

12. Termination

You may stop using the Services at any time. We may suspend or terminate your access if you breach these Terms, your use poses security or legal risk, or we discontinue the beta.

13. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT PAID BY YOU TO US FOR THE SERVICES IN THE 3 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR $100, WHICHEVER IS GREATER.

15. Indemnity

You agree to indemnify and hold ScaledRev harmless from claims arising out of your Customer Data, your use of the Services, or your violation of these Terms.

16. Governing Law; Venue

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Venue for any dispute will be in state or federal courts located in California.

17. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will provide notice via email or in-product notice. Continued use after the effective date means you accept the updates.
